GENERAL TERMS OF ONLINE SALE

1. PRICES
All the price are in Euro, without VAT

2. TERMS OF PAYMENT
-Bank transfer
-Cash on delivery
-Credit on PostePay
-Paypal and Credit Cards

3. BUYER OBLIGATIONS
When the purchase procedure is finished the customer pledges himself to print and/or keep this general conditions, and also to print the detailed list of the product bought, in order to satisfy the article n. 52 and 53 D.Lgs 206/05.
To the buyer it's severely prohibit insert false details and/or invented and/or fantasy in the recording procedure necessary to activate l'iter to the performance of this sale agreement and the further communications; private data and the e-mail must be real own personal data and not to third people.

4. CANCELLATION OF THE CONTRACT AND EXPRESSED RESOLUTORY CLAUSE
The obligation assumed by the customer in the art. 3 (Buyer obligation) and the payment's guaranty have essential character as the expressed agreement, if the Customer is defaulting at only one of these obligation, he will determine the cancellation of the right contract ex art. 1456 c.c., without necessity of judicial pronounce, excepted the Terra dei Sensi's rights to summon to the compensation for damages.

5. JURISDICTION AND PLACE OF JURISDICTION
Every litigation pertinent to the application, execution, interpretation and breach of the on line contract of sale is submitted to the Italian Jurisdiction; these general conditions are reported to the provision of D.Lgs. 50/92 and D.Lgs. 206/05, even if there is not foreseen explicity. Every litigation between the parties about this contract will be to exclusively competence of Macerata place of jurisdiction.
Per qualsiasi controversia tra le parti in merito al presente contratto sarą di esclusiva competenza del Foro di Macerata. 

6. POWER OF EXERCISE THE RECESSION RIGHT ACCORDING TO D.LGS.206/05
Are left out from the legislative decree unclassifiable people like consumer, or who acts to own aims referable to professional activities carried on, so who make an order indicating the VAT registration number for the invoice.
Customer can pull out of a contract without any penalty and without saying the reason, not later than 10 (ten) workdays from the delivery ( the prove is the delivery date reporting on the messenger consignment note).
Recession right can be exercised within the foreseen time sending a registered letter with advice of delivery and all the bought goods to the following address: Terra dei Sensi di Lupi Simone - Via Gentiloni Silverj, 3 - 62029 Tolentino (MC) - ITALY.
In case of recession right applicability, the Customer has to send back at his expense all the articles referable to the invoice, like there are arrived or rather new, not used, complete of the entire part and in the original packing ( envelopes and wrapping).
If you don't observe these principles recession right can't be applicable.
Goods must be send back by a correctly wrapping parcel with a copy of consignment note to the address: Terra dei Sensi di Lupi Simone - Via Gentiloni Silverj, 3 - 62029 Tolentino (MC) - ITALY.
In case of recession right application, when the goods are arrived Terra dei Sensi will provide to the refund of the entire amount paid from the customer, except forwarding charges, within thirty days from the date in which the communication is arrived by the following formality: change goods, bank transfer.

7. SUPPLIER RECESSION
If Terra dei Sensi couldn't carry out the required order, it has the faculty of recess the sell agreement within 30 days from the ordination date supplying to the customer a simple motivated communication according to the article 54, paragraph 2 D.Lgs. 206/05. In this case the customer will have the right only to the amount that he has already paid. 

8. DAMAGED OR TAMPERED PACKAGE
If you don't receive a perfect package, damaged or with evident tampered signs you have to say it to the courier and absolutely sign the consignment note adding the wording "WITH RESERVE". It allows you to protect yourself if you found out any type of anomaly after the opening of the item. Only in this last case you will signal what happened via fax to the courier and to copy to Terra dei Sensi.
